Law of Contract II
About this subject
Upon completion of this subject, students will be able to:
- demonstrate knowledge of contract performance, breach, termination, damages, liquidated damages, actions for debt, vitiating factors and remedies, and illegality and its effects;
- use initiative and judgement to identify, evaluate and summarise rules of contract law as per unit content;
- communicate legal issues, relevant principles and concepts, and analysis citing relevant authorities coherently, in order to develop persuasive legal argument; and
- use cognitive and creative skills to independently apply unit content to particular fact-based problems, citing authorities and using persuasive legal argument.
- Topics will be available to enrolled students in the subjects Learning Management System site approximately one week prior to the commencement of the teaching period.
This subject continues the investigation of the law of contract begun in LAW171 Law of Contract I. The unit deals with the second half of the law of contract, including termination and breach of contract, remedies and vitiating factors.

There is a supervised exam at the end of the teaching period in which you are enrolled. The exam will be offered online with supervision via webcam and screen sharing technology. Coordinated by UNE Exams Unit.

To enrol in this subject you will need to pass UNE-LAW100 and UNE-LAW101 and UNE-LAW171 subjects. Please note as UNE results are released after the close of enrolment date, your enrolment into this subject will be withdrawn if you do not receive a satisfactory result for UNE-LAW100 and UNE-LAW101 and UNE-LAW171.
This is a paired unit with UNE-LAW171. Students who have successfully completed LAW171 should undertake this unit in 2020. If students do not undertake and successfully complete this unit in 2020, they will need to complete UNE-LAW172. UNE-LAW171 will then count as a Listed Law Unit rather than a Core Unit.
Students who complete UNE-LAW172 do not undertake this unit.
