Public international law permeates most areas of Australian law and it is therefore essential for law graduates to have a solid grounding in the sources and methodology of international law. This subject develops students&#39; understanding of the sources of international law, state responsibility, international dispute settlement, and treaty making. It introduces students to specific fields of international law, including international humanitarian law, environmental, human rights and Indigenous issues, the Antarctic Treaty system, the use of force and the relationship between international and Australian law. The subject fosters students&#39; interest and engagement with international law by exploring links with a range of contemporary contentious political issues both nationally and internationally. A key component of the subject is to introduce and practise a range of fundamental legal research skills that are essential to investigating International Law studies and wider legal studies.

In an increasingly interdependent world, international law and international organisations are playing an important part in regulating human activity, both within and between states. In this subject you will examine this trend, and its implications for the theory and practice of state sovereignty and international relations in a rapidly changing world. The trend is then considered with reference to developments in international law and organisations since 1945. Special attention is directed to the role of international organisations in conflict resolution, the laws of war, humanitarian law, international environmental law and the law of the sea, international health regulations, and refugee law. How effective is international law at regulating state and human behaviour? What role do international organisations play in the development and enforcement of international laws and norms? And how could international law and organisations more effectively regulate the excesses of sovereign states?This is a level 2 subject. This subject aims to provide you with a comprehensive and critical knowledge of international law, including ‘public’ international law and the fundamentals of ‘private’ international law. The subject explains the different areas of international relations, including sovereignty, the law of the sea and outer space, peace and war, diplomatic and consular relations, international economic law, international environmental law, human rights and international criminal law. You will be familiarised with the functioning of the principles governing different international legal regimes, including international legal personality, the sources of international law and international responsibility. The reflective element of this subject will build your problem solving and communication skills as well as your technical vocabulary, with opportunities to explore and demonstrate your understanding of international law in various contemporary scenarios.

This subject provides you with a rigorous overview of harmonisation of domestic crimes and criminal procedures as well as international crimes and criminal procedures. The particular focus on harmonised crimes, such as terrorism and related proceedings, encourages critical analysis of a range of international criminal law concepts and principles. You will also develop your understanding of specific supranational crimes, such as crimes against humanity, aggression, war crimes and related proceedings, as well as consider the fundamentals of the international law of war.

International Criminal Law

This subject introduces students to fundamental principles in international environmental law and examines certain important issues in this area at the global level. More specifically, the subject will critically analyse the significant principles involved in the operation of the international legal system and how the international community, through law and policy, responds to global and regional environmental issues. A sectoral approach will then be taken by examining the application of international environmental law in certain specific areas. The main focus will be on examining the law and policy which has been applied to deal with environmental problems in an international and transboundary context. Special reference to domestic laws and initiatives will be made in evaluating the impact of international environmental obligations on natural resource management.

International Environmental Law

This subject was previously known as Human Rights Instruments and Institutions.This subject explores international and national human rights systems, including the role of the United Nations and international and national laws in defining, protecting and upholding human rights. Topics include human rights treaties; the recognition of Indigenous rights, racial and ethnic minority rights, women&#39;s rights and the rights of other groups; international and regional reporting and complaint mechanisms; and the role of non-government organisations. The subject also includes a practical simulation exercise to understand how the global human rights system operates in practice.Please Note: If it’s your first time studying a Curtin University subject you’ll need to complete their compulsory ‘Academic Integrity Program’. This course provides instruction in contemporary developments in international cultural property law, the application of law (domestic and international) by tribunals that have jurisdiction to decide cultural property cases, conflicts of law arising in cultural heritage cases, and the international law status of cultural heritage objects taken from rightful owners.

International Cultural Heritage Law

This course provides an introduction to the politics of international organisations and international law from the perspective of the International Relations (IR) discipline, with a specific focus on peace and conflict. More specifically, it aims to introduce students to i) the main IR approaches to studying international organisations and law and the key debates surrounding them ii) some of the most influential international organisations and legal frameworks and how they operate and iii) central issues pertaining to international law, norms and organisations in the areas of peacekeeping, conflict prevention and human rights. Students should not enrol in this subject if they have previously completed 2019IBA Politics of International Law &amp; International Organisations, 2019GIR Politics of International Law and Organisations or 2019GIR International Organisations, Peace and Conflict.

International Organisations, Peace and Conflict

This subject was previously known as POIX108 Introduction to Global Politics.Globalisation has had dramatic implications for the structure and conduct of global politics, now defined by the multiplication of actors and networks. Contemporary crises can no longer be contained within state borders and global problems such as climate change, poverty, health insecurities, and violent conflicts call for global solutions. This unit equips students with the tools to understand the forces that shape the world we live in by introducing them to the key issues, institutions, ideas, and actors involved in global politics. It first outlines the historical context, key theories and concepts, and fundamental institutions of contemporary global politics. Students will then explore important contemporary global issues and crises. Overall, the unit provides students with foundational knowledge about the complexity of global politics, problems and solutions.

Gain a global perspective on issues like poverty, climate change and terrorism. Broaden your understanding of the history of global politics. Identify the challenges facing international governing bodies. Ask what you can do to change the world.

This subject was previously known as POIX101 Australian Politics in Global Context.In this subject, we critically assess Australian politics from the perspective of political and economic history, through the lens of social power and financial interests, and drilling down into contemporary debates about economic crisis, globalisation, nationalism, environmental catastrophe and war. With this approach in mind, we examine key Australian political institutions, ideologies, and issues. What is the nature of Australia’s key political institutions (the Constitution, the High Court, Federalism, Government and Parliament), and are they democratic and just? Could we live without them? What are some of the radical critiques of these institutions and the interests they serve? What is ‘Australia’, after all – a unified nation of peoples with shared identities and interests, or a construct that serves wealth and power by masking deep social fractures, or something else again?

Stare down the barrel of Australian political history. Learn about the Dismissal and the Great Depression. Investigate the two-party system and other political institutions. Take on debated hot topics such as globalisation, climate change and war.
