The Diploma in Paralegal Studies course provides students with the opportunity to complete a course dedicated to preparatory skills and studies in law, regardless of their educational background.This course will be attractive to students who would like to graduate with a diploma by completing 8 units. This course also offers students who wish to continue their studies in law the opportunity to transfer to the Bachelor of Legal Studies or to take advantage of the pathway to a law degree (provided they satisfy the GPA requirement). It will also attract those with a general interest in law and those who wish to study particular areas of law in order to be able to work, for example, as a paralegal or legal secretary.UNE is home to Australia&#39;s largest law school outside a capital city, as well as being an early adopter of innovative technology in the delivery of our law programs. With UNE, you will build your preparatory legal knowledge and skills to pursue your unique goals, regardless of your educational background.Please note: students will only be admitted to the full Diploma in Paralegal Studies upon successful completion of the two open subjects [LSU100 and LAW100] with a minimum grade point average (GPA) of 4.0.The Diploma in Paralegal Studies aims to graduate students who can demonstrate:<ol><li>a knowledge of the fundamentals of the Australian legal system;</li><li>knowledge of areas that include criminal law, dispute resolution, law and first peoples of Australia;</li><li>competence in written communication.</li></ol>

An understanding of how the legal system works is a valuable skill for students pursuing a wide range of career outcomes. This subject is suited to non-law students and provides a comprehensive introduction to legal studies, starting you on the path to achieving an understanding of how legal systems operate in Australia and elsewhere. You will explore the ways in which the law is made, and how law applies in various contemporary contexts. As part of your study, you will also develop introductory level skills in legal research, writing and analysis.

This introductory subject will help you to gain a foundation in contemporary legal knowledge: from how the legal system operates to how the law is made, and its role in our changing society. You will learn how to find and interpret the principal sources of law as well as apply legal principles to solve problems. Additionally, you will develop your skills in planning, organising and communicating complex material. Whether you are studying this subject as the first step towards a legal career or to broaden your general knowledge, this subject will help you to develop the knowledge and capabilities necessary to be a successful learner and valuable professional.

In an era of global business transformation and the rise of privatisation, studying Contract Law will equip you with a solid understanding of the journey through a contract, ensuring you have the skills to apply to real-world business scenarios.   This subject examines the legal aspects of obligations arising from agreements or promises and will provide you with a thorough overview of the formation of enforceable contracts, identifying and defining terms, performance, discharge and remedies.  This subject meets the Priestley requirements for contracts.

Cover principles of common law, equity, statutory provisions, interpretation and enforceability in relation to contracts. Use critical thinking, communication and judgement to analyse case law, persuade and find solutions.

Contract Law

This subject is designed to familiarise you with the advanced and specialist knowledge of interviewing in the context of the practice of law, advocacy and the preparation for litigation. You will gain a broad understanding of theories of psychology, law, communication and linguistics relevant to interviewing and recognising the legal, social, cultural and political factors that may impact on questioning and interviewing different cohorts. These include children, juveniles, the elderly, the vulnerable, victims and suspects of crime, people living with disability and First Nations people. You will also apply your theoretical knowledge to develop your practical skills in interviewing questioning and communication techniques with a view to preparing written witness testimony.

Interviewing for Advocacy

Responding and successfully resolving disputes is a core skill for lawyers. Skills in dispute resolution add value to your role in a wide range of workplaces. This subject equips you with a thorough understanding of ADR processes both in criminal and civil matters such as arbitration, negotiation, conciliation and mediation. The subject also examines Australian Indigenous Peoples&#39; dispute resolution processes. There are opportunities to critically analyse disputes and evaluate alternatives to litigation. You may build your capabilities in the art of effective listening and negotiating. These are fundamental bases of ADR. These skills are in high demand across many industries.

Alternative Dispute Resolution

This subject provides you with a comprehensive introduction to substantive criminal law as well as an introduction to the key elements of criminal procedure.  After completing this subject, you will be able to identify the essential elements of an offence and of selected defences and apply the general principles of the criminal law.  You will understand the distinction between substantive and procedural law as well as the procedural framework that applies to criminal law, with opportunities to apply your knowledge and critical thinking skills to analyse a variety of criminal law issues.  This subject meets the Priestley requirements for criminal law and procedure.

Break into criminal law as you cover burden of proof, identification of actus reus and mens rea, relevant statute and case law. Learn to interpret legislation, identify elements of the offence, and ultimately give persuasive legal arguments.

Criminal Law

This subject provides you with a rigorous overview of harmonisation of domestic crimes and criminal procedures as well as international crimes and criminal procedures. The particular focus on harmonised crimes, such as terrorism and related proceedings, encourages critical analysis of a range of international criminal law concepts and principles. You will also develop your understanding of specific supranational crimes, such as crimes against humanity, aggression, war crimes and related proceedings, as well as consider the fundamentals of the international law of war.

International Criminal Law

This subject provides you with a comprehensive insight into the principles of fact-finding and proof in the context of the application of the rules of evidence.  You will explore the court process and adducing evidence in court proceedings, enhancing your critical thinking skills and ability to formulate persuasive legal arguments and solutions to fact-based problems.  Throughout, you will build transferable legal reasoning and analytical skills.

Evidence and Proof

This subject provides you with a comprehensive insight into succession law.  You will gain a broad depth of knowledge in the theory and practice of succession law and be introduced to a range of topics related to wills including testamentary succession, testamentary capacity, knowledge and approval, undue influence, formal requirements, revival and revocation and the construction of wills.  Additionally, you will explore distribution on intestacy, grants of administration and the role of executors and administrators, administration of assets and family provision.  Throughout, you will also develop your legal reasoning and critical thinking skills.

Succession

Torts are common law actions for civil wrongs. This subject provides you with a social context of the law of torts and covers negligence including defences, damages, concurrent liability and compensation schemes.  You will consider torts relating to personal, property, and economic interests and their defences. In particular, you will consider the quantum of damages.  This subject will provide you with a good understanding of the black-letter law, whilst incorporating skills-based approaches. You will be encouraged to take a critical view of the law, particularly with regard to current tort reform.  This subject meets the Priestley requirements for torts.
