This subject covers a range of legal topics relating to the business environment. It combines topics that are necessary for a consideration of business and corporate law including: an introduction to the legal system; contract law principles; sale of goods; competition and consumer law; tort law; law of agency; business structures and basic corporate law and governance principles. The subject teaches students how to analyse, and solve legal problems, all essential skills for those wishing to work in both the fields of accounting and business management.

Business and Corporate Law

A subject suitable for both law and non-law students, this subject introduces students to Indigenous people’s experience with the legal system in Australia and selected other jurisdictions (United States, Canada and New Zealand), and the interactions between non-Indigenous and Indigenous legal systems. With regard to both the historical and contemporary setting, the subject examines these themes in a variety of contexts including land rights and native title, Indigenous peoples and environmental management, the criminal justice system, and Indigenous ownership of intellectual and cultural property. The subject matter is rapidly changing, and new issues such as the negotiation of a treaty in Australia between Indigenous and non-Indigenous peoples, and constitutional law reform to give Indigenous peoples a voice in the Commonwealth parliament, are considered. The subject also considers options for law and policy reform in a variety of contexts including the criminal justice system and women’s rights.

Indigenous Peoples and the Law

Human rights are fundamental rights that are inherent to every individual. They are underpinned by concepts of human dignity and the essential equality of all people. The subject takes an interdisciplinary approach to the development, application and cultural relativity of human rights, and how they are placed alongside our notions of global justice.The subject is delivered in three modules. The first module explores the evolution of the liberal conception of human rights, with a focus on how the understanding of rights has changed over time. The second module introduces students to non-Western conceptions of human rights, with a focus on indigenous conceptions. The third module discusses who guarantees protection of rights, and how violators of rights have come to be punished in the international system. The material covered in this subject is global in both its geographic scope and its cultural awareness. The subject will provide you with the tools to make determinations about the nature of human rights in a globalised world.

Human Rights and Global Justice

This subject introduces you to the key elements of domestic Australian and Indigenous legal systems, and considers how they compare with other legal systems around the world. You will gain an introduction into how law is made in Australia by courts and the legislature, within Australia’s constitutional framework, and consider how Tasmania’s legislature and the courts have addressed contemporary and historical social issues. You will consider how a person’s place within society influences the way they perceive and evaluate law and will be introduced to several ethical issues and rules that arise for different actors within the legal system. This will be your first opportunity to learn skills that are fundamental to your future studies and careers in law: working effectively in small groups; critical thinking; how to read and take good notes from class and texts; and how to manage study time to achieve success in law.

Foundations of Law

Public international law permeates most areas of Australian law and it is therefore essential for law graduates to have a solid grounding in the sources and methodology of international law. This subject develops students&#39; understanding of the sources of international law, state responsibility, international dispute settlement, and treaty making. It introduces students to specific fields of international law, including international humanitarian law, environmental, human rights and Indigenous issues, the Antarctic Treaty system, the use of force and the relationship between international and Australian law. The subject fosters students&#39; interest and engagement with international law by exploring links with a range of contemporary contentious political issues both nationally and internationally. A key component of the subject is to introduce and practise a range of fundamental legal research skills that are essential to investigating International Law studies and wider legal studies.

International Law

The ‘blue economy’ of oceans related industries is set for significant expansion in the first half of twenty first century. Australia has one of the largest areas of ocean estate in the world. Tasmania is also are a global centre for scientific research, governance and logistical support for Antarctica and the Southern Ocean. This subject leverages off these strengths to provide students with essential knowledge and understanding of the key international legal regimes and policy debates relating to the oceans and Antarctic region. The subject will examine the key provisions of treaties and institutions such as the United Nations Convention on the Law of the Sea, Antarctica Treaty System and International Whaling Commission, which govern scientific research, environmental protection, marine resource harvesting and other human uses of the oceans and Antarctic region. The subject will also introduce students to the interplay between international law and geopolitics that shape the rules and institutions governing the future of our oceans and the Antarctic region.

Law of the Oceans and the Antarctic

Strong legal reasoning skills are critical to student learning and performance while at law school and eventually to the quality of your legal practice. More broadly, many employers beyond the legal profession consider the ability to solve problems by identifying issues, developing arguments and expressing reasoning processes and decisions in a clear and cogent manner to be a highly desirable attribute. The subject is designed with one ultimate aim in mind: to equip students with the analytical legal reasoning skills and knowledge needed to perform well across the remainder of their legal studies. Having successfully completed this subject, you should feel confident in your ability to find, read, analyse and make strategic arguments with case law and legislation. You should also understand how technology is providing lawyers (including judges) with new ways to carry out legal analysis and make decisions pursuant to law and how these changes challenge traditional conceptions and approaches to law and legal reasoning. These changes raise new and fascinating legal and ethical challenges which are explained throughout this subject, with references to recent case studies. The Legal Reasoning subject reflects the diversity of the institutions and laws within Australia&#39;s legal system, adopting design principles and learning from Australia, England and America and the case studies used are drawn from a range of common law countries.

Legal Reasoning and Technological Change

KSA101 will provide a background to the science and management of the seas with focus on Antarctic and Southern Ocean. On the completion of this subject, students will demonstrate a knowledge and comprehension of the contemporary issues facing Antarctic, marine and coastal environments, and the management strategies used to optimise the value (market and non-market) of these areas.

Explore Antarctica and the Southern Ocean. You’ll learn how governments manage the southernmost coasts and seas of the world. Cover contemporary issues as well as some historical, legal, and political topics.

Introduction to Marine and Antarctic Science A

This subject provides an introduction to the fundamentals of political science. It introduces students to some of the central ideas, concepts, actors, institutions and processes which characterise politics in democratic nations. It uses examples and case studies from Australia and across the democratic world to highlight the challenges confronting advanced democracies in the 21st Century.

Introduction to Politics and Policy

The subject offers a broad overview of the major theories and approaches to the study of crime and deviance. It provides a survey of diverse and competing interpretations of criminal and deviant acts, the situations and contexts within which crime and deviance are defined and take place, and the explanations put forward for the causes and consequences of deviance in society. The subject encourages students to think critically and practically engage with the key questions and colourful issues that criminologists face, including why and how some behaviours and subcultures are regarded as deviant or criminal and others are not. Each theoretical perspective is vividly illustrated throughout the subject with contemporary applications in topical lectures and tutorials. For example, the subject may cover topics like youth crime and youth gangs, sex work and sexuality, crimes of the marginalised and the powerful, terrorism and counter-terrorism, as well as analysing the dynamic impact of stigma, moral panics and social control on individuals and society.
