A subject suitable for both law and non-law students, this subject introduces students to Indigenous people’s experience with the legal system in Australia and selected other jurisdictions (United States, Canada and New Zealand), and the interactions between non-Indigenous and Indigenous legal systems. With regard to both the historical and contemporary setting, the subject examines these themes in a variety of contexts including land rights and native title, Indigenous peoples and environmental management, the criminal justice system, and Indigenous ownership of intellectual and cultural property. The subject matter is rapidly changing, and new issues such as the negotiation of a treaty in Australia between Indigenous and non-Indigenous peoples, and constitutional law reform to give Indigenous peoples a voice in the Commonwealth parliament, are considered. The subject also considers options for law and policy reform in a variety of contexts including the criminal justice system and women’s rights.

This subject introduces you to the key elements of domestic Australian and Indigenous legal systems, and considers how they compare with other legal systems around the world. You will gain an introduction into how law is made in Australia by courts and the legislature, within Australia’s constitutional framework, and consider how Tasmania’s legislature and the courts have addressed contemporary and historical social issues. You will consider how a person’s place within society influences the way they perceive and evaluate law and will be introduced to several ethical issues and rules that arise for different actors within the legal system. This will be your first opportunity to learn skills that are fundamental to your future studies and careers in law: working effectively in small groups; critical thinking; how to read and take good notes from class and texts; and how to manage study time to achieve success in law.

Public international law permeates most areas of Australian law and it is therefore essential for law graduates to have a solid grounding in the sources and methodology of international law. This subject develops students&#39; understanding of the sources of international law, state responsibility, international dispute settlement, and treaty making. It introduces students to specific fields of international law, including international humanitarian law, environmental, human rights and Indigenous issues, the Antarctic Treaty system, the use of force and the relationship between international and Australian law. The subject fosters students&#39; interest and engagement with international law by exploring links with a range of contemporary contentious political issues both nationally and internationally. A key component of the subject is to introduce and practise a range of fundamental legal research skills that are essential to investigating International Law studies and wider legal studies.

International Law

The ‘blue economy’ of oceans related industries is set for significant expansion in the first half of twenty first century. Australia has one of the largest areas of ocean estate in the world. Tasmania is also are a global centre for scientific research, governance and logistical support for Antarctica and the Southern Ocean. This subject leverages off these strengths to provide students with essential knowledge and understanding of the key international legal regimes and policy debates relating to the oceans and Antarctic region. The subject will examine the key provisions of treaties and institutions such as the United Nations Convention on the Law of the Sea, Antarctica Treaty System and International Whaling Commission, which govern scientific research, environmental protection, marine resource harvesting and other human uses of the oceans and Antarctic region. The subject will also introduce students to the interplay between international law and geopolitics that shape the rules and institutions governing the future of our oceans and the Antarctic region.

Law of the Oceans and the Antarctic

Strong legal reasoning skills are critical to student learning and performance while at law school and eventually to the quality of your legal practice. More broadly, many employers beyond the legal profession consider the ability to solve problems by identifying issues, developing arguments and expressing reasoning processes and decisions in a clear and cogent manner to be a highly desirable attribute. The subject is designed with one ultimate aim in mind: to equip students with the analytical legal reasoning skills and knowledge needed to perform well across the remainder of their legal studies. Having successfully completed this subject, you should feel confident in your ability to find, read, analyse and make strategic arguments with case law and legislation. You should also understand how technology is providing lawyers (including judges) with new ways to carry out legal analysis and make decisions pursuant to law and how these changes challenge traditional conceptions and approaches to law and legal reasoning. These changes raise new and fascinating legal and ethical challenges which are explained throughout this subject, with references to recent case studies. The Legal Reasoning subject reflects the diversity of the institutions and laws within Australia&#39;s legal system, adopting design principles and learning from Australia, England and America and the case studies used are drawn from a range of common law countries.

Legal Reasoning and Technological Change

This subject explores some of Australia’s most challenging environmental controversies, and the legal and policy context in which they arise. It uses a range of topical issues and case studies to introduce students to the framework for national and international environmental regulation, encouraging them to see how laws operate and apply in specific situations.Through these case studies, students will appreciate common themes and challenges in environmental governance, including:• failures of enforcement and implementation• problems of overlapping and overly complex regulation across local, state and national laws; • challenges for implementing the principles of ecologically sustainable development through law;• the role of international law in influencing domestic environmental law;• the importance of public participation in environmental decision-making; and• the role of markets, media, human rights and environmental ethics in environmental protection.

Current Issues in Environmental Law and Policy

Become better prepared to understand concepts of ethics, social responsibility and the law and how these shape individual and collective behaviour in modern society. Sustainable inspirational leadership can only evolve from a legitimate, ethical and socially responsible base. Equally, reputations can be damaged as a result of conduct that is unethical or unlawful and which may have come about as a result of poor judgment and lack of insight and reflection.  This subject will challenge your current thinking and ask you to explore different perspectives around ethics, social responsibility and the law and their interconnections. It will equip you to navigate complex professional ethical dilemmas and make positive choices that are individually affirming and socially responsible. Social responsibility is also explored at the collective level and how this is shaping the modern corporate world with growing expectations on companies to demonstrate corporate social responsibility.  You will learn theoretical philosophical principles that encompass ethical decision-making and explore how ethical frameworks can assist a person to make appropriate, rationally defensible decisions within a range of settings: professional ethics, with a particular focus on how ethics influences the life of a legal professional; medical ethics and the contemporary research environment; business ethics and the ethical expectations underpinning corporate social responsibility; and the context of policy settings to minimise criminal behaviour.The subject will equip you to navigate complex professional ethical dilemmas and make positive choices that are individually affirming and socially responsible. Social responsibility is also explored at the collective level and how this is shaping the modern corporate world with growing expectations on companies to demonstrate corporate social responsibility.

This subject introduces an important area of private law, and examines the historical development and operation of specific Torts including trespass to person, nuisance, negligence, defamation and relevant intersecting laws. It also considers the relationship between various areas of Tort Law, and other areas of private law. The subject develops students&#39; confidence in legal research, analysis, providing legal advice and problem solving.

Torts

This subject introduces you to concepts and principles of maritime law, with special emphasis on the carriage of goods by sea. However, we will also deal with other traditional aspects of maritime law - salvage, general average, maritime liens, admiralty jurisdiction, and marine insurance law. It must be borne in mind that we will deal with each topic in this subject in a very introductory nature while in fact, maritime law cuts across many branches of law - being domestic or international, procedural or substantive, and arguably no one can claim himself/herself to be an expert in all aspects of maritime law. Hence, for those without a good understanding of the law and the legal system generally, you may find that you will have to put some extra time and effort into this subject to make sense of it. Despite the challenging nature of this subject, it is beyond doubt that you will find what you study in this subject to be highly relevant to your future career in maritime and logistics.This subject is divided into 12 modules of study. Module 1 introduces sources of maritime law in Australia and gives an overview of relevant concepts of national law and international law as they are pertinent to shipping. Continuing along the theme of public international law, Module 2 touches upon the law of the sea. Modules 3-7 focus on the challenges of carriage of goods by sea and the question of the carrier&#39;s liabilities. This is a careful consideration of how the law allows for the efficient and regular international transportation of goods. Module 8 deals with the traditional aspects of maritime law in the event of imminent danger - salvage and general average. Some practitioners, however, argue that the general average is declined in its importance due to the existence of the marine insurance system. Therefore, Module 9 deals with marine insurance law. Modules 10-11 deal with dispute settlements in the context of maritime cases with a primary focus on the function of the courts in admiralty jurisdiction and international maritime arbitration. Module 12 then introduces some legal aspects of disruptive technologies in the maritime business.

Maritime Law

Sports doping is a truly international problem and has a significant impact on today&#39;s society; from cheating, to the politics and ethics of sophisticated doping programs, the enormous bureaucracy and cost of monitoring and prosecuting, along with the impact on an individual&#39;s mental and physical health. Students will recognise drug classes that can enhance athletic performance, and that both doping and detection technologies are constantly evolving, leading to a sports doping arms race between detection and doping which drives newer and ever more sophisticated methods of cheating. The subject begins with an overview of drug classes that are prohibited in sport, their mechanisms of action, effects on performance, and health effects. Students will then learn to appreciate the ethical and legal issues associated with sports doping detection, as well as an introduction into analytical testing methods and processes to ensure sample integrity. The subject incorporates online learning activities consisting of lectures and supportive contextual media, as well as experiential application of internet resources.
