About this subject
Upon completion of this subject, students should be able to:
- Explain the legal framework underpinning domestic and international maritime law
- Identify and apply key maritime law principles
- Communicate legal thought in a clear, direct and professional manner
- Analyse the conceptual foundations of key maritime law principles
- To be confirmed prior to commencement.
This unit is divided into 12 modules of study. Module 1 provides an introduction to sources of maritime law in Australia and gives an overview of relevant concepts of national law and international law as they are pertinent to shipping. Module 2 continues on the theme of international law with the international law of the sea. Module 3 then considers legal framework on international carriage of passengers by sea.
Modules 4-8 focus on the challenges of carriage of goods by sea and the question of the carriers liability. This is a careful consideration of how the law allows for the efficient and regular international transportation of goods. Modules 9-11 cover some traditional aspects of maritime law that may arise in connection with carriage of goods by sea. Module 12 deals with the law relevant to maritime policy by focusing on the recent changes brought by the enactment of the Navigation Act 2012 (Cth).
