Remedies and Advanced Legal Skills
About this subject
Upon completion of this subject, students will be able to:
- demonstrate an understanding of the use of legal, equitable, and statutory remedies;
- demonstrate advanced skills in finding parliamentary and delegated legislation relevant to a legal question, and extrinsic material relevant to that legislation;
- demonstrate a high level of proficiency in applying legislative provisions to legal questions;
- demonstrate a high level of proficiency in finding case law; this includes case law relevant to particular statutory provisions and applying it to legal questions;
- demonstrate strong interpersonal skills in order to collaborate effectively with others in preparing and presenting written and oral submissions in a moot; and
- demonstrate overall enhanced skills in speaking and legal writing clearly, concisely, and correctly in plain language.
- Topics will be available to enrolled students in the subjects Learning Management System site approximately one week prior to the commencement of the teaching period.
This is a capstone subject. It is at the experiential end of the legal studies spectrum. The unit brings together the theory and practical skills students have developed throughout their course. The unit hones students’ legal research skills, the ability to apply legal authority, and the capacity to argue persuasively.
The subject has three modules:
- Module I enhances students' legal research skills to an advanced level. This module also considers legal, equitable, and statutory remedies;
- Module II sharpens students’ skills in speaking and writing clearly, concisely, and correctly in plain language; and
- Module III requires students to prepare written submissions based on a legal problem. Students must then present their oral submissions as advocates in the Moot Court.
